H-4 EAD: Who Qualifies and How to Apply

H-4 status alone does not authorize work. USCIS says an H-4 spouse of an H-1B worker may qualify for an employment authorization document (EAD) if the H-1B spouse is the principal beneficiary of an approved Form I-140, or has H-1B status under sections 106(a) and (b) of a law called AC21. The H-4 spouse applies on Form I-765 and, per USCIS, "must receive an Employment Authorization Document (EAD/Form I-766) from USCIS before you may begin working." Renewal rules changed in October 2025: renewals filed on or after October 30, 2025 do not receive an automatic extension.

What the regulation says

8 CFR 214.2(h)(9)(iv) states: "H-4 nonimmigrant status does not confer eligibility for employment authorization incident to status." It then says an H-4 spouse of an H-1B nonimmigrant "may be eligible for employment authorization only if" the H-1B nonimmigrant is the beneficiary of an approved immigrant petition (Form I-140) or has H-1B status authorized under AC21 sections 106(a) and (b). To request employment authorization, an eligible H-4 spouse must file an Application for Employment Authorization with documentary evidence of eligibility. The employment authorization regulation, 8 CFR 274a.12(c)(26), lists "An H-4 nonimmigrant spouse of an H-1B nonimmigrant described as eligible for employment authorization in 8 CFR 214.2(h)(9)(iv)."

Who qualifies, according to USCIS

The USCIS page on H-4 dependent spouses (last reviewed 08/02/2024) says you may qualify if your H-1B spouse either:

  • is the principal beneficiary of an approved Form I-140, or
  • has H-1B status under AC21 sections 106(a) and (b), which USCIS describes as allowing H-1B nonimmigrants seeking employment-based lawful permanent residence to remain in the United States beyond the six-year H-1B limit.

The page is about spouses. It does not describe an EAD for H-4 children, so we do not either.

Form, category and evidence

The form is Form I-765. If you file it together with Form I-485, the USCIS H-4 page says "you must specify your eligibility category as (c)(9), not as (c)(26)." USCIS's Form I-765 page says you may file Form I-765 at the same time as your Form I-539 and your H-1B spouse's Form I-129. Form editions, fees, photo rules and the mailing location for Form I-765 have changed recently, so we do not list them. Use the USCIS Form I-765 page and the fee schedule. Our Form I-765 page has the form basics.

The H-4 page (last reviewed 08/02/2024) lists these kinds of evidence, which you should confirm against the current Form I-765 instructions:

  • H-4 status: a current I-797 approval for Form I-539, or your I-94.
  • Photo ID: a prior EAD, passport biometric page, or another listed document.
  • Marriage certificate.
  • Basis for eligibility: an I-797 approval for your spouse's I-140, or, for AC21 eligibility, documents showing the H-1B spouse's status and evidence of a qualifying labor certification or pending I-140 filed at least 365 days before the period of admission authorized under AC21 begins.
  • Translations: a certified English translation for any foreign-language document.

Validity and renewal

USCIS says you will not be authorized to work until USCIS approves your Form I-765, and that the EAD expiration date should be the same as the expiration date on your most recent Form I-94. To renew, you file a new Form I-765. USCIS's H-4 page, reviewed 08/02/2024, says you "cannot file for a renewal EAD more than 180 days before" the current EAD expires. Check the Form I-765 page for the current filing rules.

No automatic extension for renewals filed on or after October 30, 2025

An interim final rule from DHS, published in the Federal Register on October 30, 2025, ended the automatic extension for renewal applications filed on or after that date. USCIS's news release of 10/29/2025 says: "Aliens who file to renew their EAD on or after Oct. 30, 2025, will no longer receive an automatic extension of their EAD." USCIS says the rule does not affect EADs that were automatically extended before October 30, 2025.

  • The regulation, 8 CFR 274a.13(e), covers renewal applications filed on or after October 30, 2025. It says the validity period of an EAD "will not be automatically extended by a request for renewal," except as provided by law, by paragraph (d) (renewals filed before that date), or in a Federal Register notice for TPS-related employment documentation.
  • For people employment authorized under 8 CFR 274a.12(c), which is where the H-4 spouse category (c)(26) is listed, paragraph (e)(2) says the EAD "will expire, and the attendant employment authorization will terminate, the day after the end validity date on the Employment Authorization Document."
  • The Federal Register rule lists "Certain alien spouses (H-4) of H-1B nonimmigrants with an unexpired Form I-94 showing H-4 nonimmigrant status (C26)" among the categories that could receive the earlier automatic extension, and then removes the automatic extension for renewals filed on or after October 30, 2025.

Some older USCIS content still mentions an automatic extension. The H-4 page (reviewed 08/02/2024) says you "may qualify for automatic extension of your existing employment authorization," and the USCIS automatic extension page (reviewed 10/29/2025) is marked archived and out of date by USCIS, yet still shows a row for C26. Those describe the rule before October 30, 2025. USCIS's current Form I-9 handbook page on automatic extensions (reviewed 07/07/2026) says that, effective Oct. 30, 2025, an EAD's validity "is not automatically extended by the timely filing of a Form I-765," unless otherwise provided by law or through a Federal Register notice. Rules can change, so check the Form I-765 page and ask an immigration attorney about your own dates.

Common questions

Can an H-4 spouse work while the Form I-765 is pending?

USCIS says you must receive the EAD before you may begin working, and that you will not be authorized to work until USCIS approves your Form I-765.

Is the H-4 EAD available to every H-4 spouse?

No. 8 CFR 214.2(h)(9)(iv) says H-4 status does not by itself confer eligibility. It ties eligibility to the H-1B spouse's approved I-140 or AC21 status.

Which category do I put when filing with an I-485?

USCIS's H-4 page says to specify (c)(9), not (c)(26).

Does my EAD stay valid after it expires if I file a renewal?

For renewals filed on or after October 30, 2025, the regulation says the EAD is not automatically extended and expires the day after the end validity date on the card. EADs that were automatically extended before October 30, 2025 are not affected, per USCIS.

How early can I file a renewal?

USCIS's H-4 page, last reviewed 08/02/2024, says you cannot file for a renewal EAD more than 180 days before the current EAD expires. Confirm the current rule on the Form I-765 page.
